On August 27th, the Department of Labor (DOL) provided new guidance, and bad news, for working parents who have chosen remote learning for their children.
Under the Emergency Paid Sick Leave Act, parents who must stay home with children because schools or daycares are closed due to the pandemic will be eligible to receive 10 days of pay at their normal rate. Additionally, parents will be eligible for 12 weeks of leave under the Emergency Family Medical Leave Act, the first two weeks unpaid, and 10 subsequent weeks paid at two-thirds of their normal rate of pay.
However, parents who have chosen remote education where there is an option to go to in-person school, will NOT be eligible to receive pay under the Emergency Family Medical Leave Act.
